Terms of Service
The following is an agreement (“TOS” or “Terms of Service”) between INSPIRE POWER PTE. LTD. Limited which is an entity incorporated the laws of Hong Kong (“INSPIRE POWER PTE. LTD.”) and you (“you” or “your”). These Terms of Service relate to, as applicable, the use of www.INSPIRE POWER PTE. LTD..com, www.INSPIRE POWER PTE. LTD..com, and/or such other INSPIRE POWER PTE. LTD. website as designed by INSPIRE POWER PTE. LTD. (the “INSPIRE POWER PTE. LTD. Site”) and the applicable INSPIRE POWER PTE. LTD. products and software (e.g., INSPIRE POWER PTE. LTD. software), including all content provided by INSPIRE POWER PTE. LTD. through such software and the INSPIRE POWER PTE. LTD. Site (the “INSPIRE POWER PTE. LTD. Software”). By accepting the Terms of Service or by accessing the INSPIRE POWER PTE. LTD. Site, you acknowledge that you agree to be bound by these Terms of Service and the Privacy Policy, which is incorporated herein by reference. If you are entering into these Terms of Service on behalf of a company, business or other entity, you represent that you have the authority to bind such entity, its employees, officers, directors, contractors, agents, parental entities, subsidiaries and its affiliates to these Terms of Service. In the event of the foregoing, the terms “you” or “your” shall also refer to such entity, its employees, officers, directors, contractors, agents, parental entities, subsidiaries and its affiliates, as applicable. You acknowledge that these Terms of Service is a contract between you and INSPIRE POWER PTE. LTD., even though it is electronic and is not physically signed by you and INSPIRE POWER PTE. LTD., and it governs your use of the INSPIRE POWER PTE. LTD. Service. If you do not agree to these Terms of Service or do not have the authority to agree to these Terms of Service (e.g., by not being an authorized representative of a company or by not being of legal age), you should not use the INSPIRE POWER PTE. LTD. Service.
1. INSPIRE POWER PTE. LTD. Service
INSPIRE POWER PTE. LTD. may revise this Privacy Policy in its sole discretion. If any such changes are made, INSPIRE POWER PTE. LTD. will endeavor to notify you of any such changes (e.g., a general notification via the INSPIRE POWER PTE. LTD. Service to all users). If you disagree with any such modifications, then you can stop using the INSPIRE POWER PTE. LTD. Site and INSPIRE POWER PTE. LTD. Service pursuant to the Terms of Service.
2. The Information INSPIRE POWER PTE. LTD. Collects
In connection with the INSPIRE POWER PTE. LTD. Service, INSPIRE POWER PTE. LTD. may obtain the below information:
A. User Provided Information:
You will provide information to INSPIRE POWER PTE. LTD., which may include your name, username, phone number, billing information and device information. The foregoing information may be provided in deciding to participate in various uses of the INSPIRE POWER PTE. LTD. Service (e.g., registering as a user, updating your data or requesting data for your contacts). If you provide any of the foregoing information regarding another user, then you must be authorized to submit such information on such individual’s behalf.
B. Content:
INSPIRE POWER PTE. LTD. may collect and store content in connection with the INSPIRE POWER PTE. LTD. Service (e.g., history, archiving, and compliance).
C. Cookies Information:
When you visit the INSPIRE POWER PTE. LTD. Site, INSPIRE POWER PTE. LTD. may send one or more cookies to your computer that uniquely identifies your browser.
D. Log File Information:
In connection with the INSPIRE POWER PTE. LTD. Service, INSPIRE POWER PTE. LTD. may log certain general information such as whenever a message is sent or received or with respect to your updates or requests for information, including time and date stamps and applicable phone numbers. In connection with the use of the INSPIRE POWER PTE. LTD. Site, INSPIRE POWER PTE. LTD. may record information when you visit a website via your web browser (e.g., your IP address, web search, the default language setting of the browser, the browser type, the last and next sequential URLs visited, the date and time of your request, nature of clicks, cookies that may uniquely identify your browser, applicable phone numbers, and other related information or data).
3. The Way INSPIRE POWER PTE. LTD. Uses Information
If you submit information to INSPIRE POWER PTE. LTD. through the INSPIRE POWER PTE. LTD. Site, or INSPIRE POWER PTE. LTD. Service, then INSPIRE POWER PTE. LTD. may use your personal information to run, maintain, and customize the INSPIRE POWER PTE. LTD. Site and INSPIRE POWER PTE. LTD. Service. Any information or Data Submissions that you voluntarily disclose on the INSPIRE POWER PTE. LTD. Service becomes available and may be collected and used by other users of the INSPIRE POWER PTE. LTD. Service. INSPIRE POWER PTE. LTD. may use your information (e.g., anonymous user usage data, cookies, IP addresses, browser type, and other information) to advance and customize the INSPIRE POWER PTE. LTD. Site and INSPIRE POWER PTE. LTD. Service including with new features and functionalities. INSPIRE POWER PTE. LTD. may use cookies and log file information to: (a) remember information (e.g., for purposes of your convenience in the use of the INSPIRE POWER PTE. LTD. Site); (b) customize content, information, and display; and (c) track relevant data metrics.
4. When INSPIRE POWER PTE. LTD. Discloses Information and Third Party Marketers
In the maintenance and improvement of the INSPIRE POWER PTE. LTD. Service, INSPIRE POWER PTE. LTD. may share your information with third party service providers. For purposes of assisting relevant third-parties with any advertisements, promotions or other third-party run functionalities in connection with the INSPIRE POWER PTE. LTD. Site, INSPIRE POWER PTE. LTD. may also share non-personally-identifiable information (e.g., anonymized data) with such third-parties. INSPIRE POWER PTE. LTD. may collect and release information in the good-faith belief that such action is necessary to comply with applicable laws (e.g., U.S. copyright law), including a court order, subpoena, or search warrant or equivalent, or if an individual’s safety may be at issue (as determined by INSPIRE POWER PTE. LTD.’ reasonable belief). INSPIRE POWER PTE. LTD. also may disclose such information in connection with government investigations and enforcement actions, to enforce the Terms of Service, to defend itself from third-party claims or otherwise limit its liability, to maintain the security of the INSPIRE POWER PTE. LTD. Site, and to otherwise protect the rights, property, and/or personal safety of INSPIRE POWER PTE. LTD., users, or others. With respect to information and/or Data Submissions obtained in the delivery of the INSPIRE POWER PTE. LTD. Service (e.g., in accordance with Section 2 of this Privacy Policy), INSPIRE POWER PTE. LTD., its affiliates, and assignees shall have an unrestricted right to use your information in concert with or as third party marketers both within and outside of the scope of the provision of the INSPIRE POWER PTE. LTD. Service.
5. Your Choices
You may decline to submit select information through the INSPIRE POWER PTE. LTD. Site or the INSPIRE POWER PTE. LTD. Service, and INSPIRE POWER PTE. LTD. may not be able to provide certain services to you. If you do not agree with the Privacy Policy or Terms of Service of INSPIRE POWER PTE. LTD., you may delete your account, uninstall the INSPIRE POWER PTE. LTD. software and discontinue use of the INSPIRE POWER PTE. LTD. Service; if you continue to use the INSPIRE POWER PTE. LTD. Service, you are expressly agreeing to this Privacy Policy and Terms of Service via such use. Please contact INSPIRE POWER PTE. LTD. via the INSPIRE POWER PTE. LTD. Site with any questions or comments about this Privacy Policy and your information.
6. Transmission of Data
INSPIRE POWER PTE. LTD. uses commercially reasonable efforts to secure its systems. However, INSPIRE POWER PTE. LTD. cannot ensure the security of any information you transmit to INSPIRE POWER PTE. LTD. and you do so at your own risk, and you should not use unsecured internet access or other unprotected networks to submit messages through the INSPIRE POWER PTE. LTD. Service. If INSPIRE POWER PTE. LTD. learns of a security systems breach, then it may attempt to notify you electronically so that you can take appropriate protective steps (e.g., INSPIRE POWER PTE. LTD. may post a notice on the INSPIRE POWER PTE. LTD. Site or through the INSPIRE POWER PTE. LTD. Service if a security breach occurs).
7. Children’s Information
INSPIRE POWER PTE. LTD. Service is not directed to minors less than 16 years of age and minors less than 16 years of age may not use the INSPIRE POWER PTE. LTD. Service. Please contact INSPIRE POWER PTE. LTD. if you learn that a minor under 16 years of age has provided information to INSPIRE POWER PTE. LTD..
8. International Hosting
TheINSPIRE POWER PTE. LTD. Site and INSPIRE POWER PTE. LTD. Service are hosted in various countries. The use of the INSPIRE POWER PTE. LTD. Site and INSPIRE POWER PTE. LTD. Service, this Privacy Policy, and the Terms of Service are governed by Hong Kong law. Further, you are likely transferring your information to other countries, and you expressly consent to that transfer and consent to be governed by Hong Kong law for such purposes.
9. Compliance with Law
You agree not to use the INSPIRE POWER PTE. LTD. Service in a manner that would violate applicable laws protecting an individual’s privacy rights, health or financial data (e.g., with respect to the United States and as applicable, HIPAA and HITECH as well as the Gramm-Leach-Bliley Act and its implementing regulations).
10. Assignment
An assignment may occur as part of a merger or acquisitions, asset transfers, sales, or other change of control (as well as in a bankruptcy, including in an assignment for the benefit of creditors). In connection with the assignment of the Terms of Service and this Privacy Policy, INSPIRE POWER PTE. LTD. may also transfer or assign the information collected from its users.
